Friend bought new M4 wrong tires?

More so curious as to what you guys think should be done. My friend just bought a Yas Marina Blue F82 from a dealership called Quality Auto Center in Springfield NJ 2 days ago. I go to check out the car and first thing I noticed the tire sizes is wayyyy off all around. They setup it up as if the rims are non staggered, with 245/45/19s all around on the OEM 437m. Obviously, the tires are severely stretched and unsafe, but the manager is claiming they're safe because "they have good tread" so he won't do anything about it. I feel bad for the guy for his first experience with this awesome ride to be hampered down by stealership trying to make a few extra bucks. What kind of recourse can he take to get any results? Looking to put a few reviews out. Would small claims be beneficial? TIA

Get hold of a factory brochure or spec sheet and put it in front of the dealer.
Stock tires are:

Factory Setup, Front: 18 x 9
Factory Setup, Rear: 18 x 10
Factory Tire Size, Front: 255/40/18
Factory Tire Size, Rear: 275/40/18

yah 245 on a 10in rim does not sound like a recipe for success. Honestly I don't know what your legal options are as I'm not a lawyer, but fundamentally that sounds like they potentially sold a car with safety liability or some form of negligence. But cars are usually sold "as-is" so I think that is pretty much blanket coverage for the dealer unless they straight up lied to get the sale (i.e BMW Beaumont)

This. Your friend bought a used car as-is/where-is. What would you possibly think a small-claims court would do? Is there a tort involved in the purchase? Did he purchase (pay for) something he didn't get? When you purchase a used car, you get what you looked at, test drove, inspected and approved - prior to the purchase. Then you agree on a price and pay for your purchase. Unless there was some part of the sale that was hidden, undisclosed or switched - your friend got what he/she paid for. If I were buying a used car, one of the first things I would inspect would be the tires. That's what holds you to the road and keeps you safe

Keep the rears for spares or sell and make money to offset the cost of the right size tires.

Definitely 245/45r19 and not 245/40r19 or 245/35r19? They'll be very tall.

Perhaps go to tirerack and look up the model of tire and see what their rim width spec is? I looked up a few 245/45r19 and they have a maximum width of 9" - then perhaps contact the tire manufacturer and see what they say about running that size tyre on a 10" wheel.

I'm sure at that stage a single paragraph explaining the situation will be enough to scare the dealer

Wrong size tires, but they aren't unsafe.

The dealership isn't going to help you.

Politely ask the dealer where they buy their tires (probably a place very close to the dealership itself), go there and ask if you can pay a little extra to get the correct size tires put on the car and return those. Sometimes local tires places will let you do that.

I didn’t like the tires that came with my wife’s new Mazda CX-5. I bought new tires from Discount Tires and they bought the factory stock tires from me.

By the way the correct tires size for 437M wheels is 255/35/19 fronts and 275/35/19 rears for an M4.

Small claims court for tires because of buyers negligence? Absolutely not..your friend will need to eat it up and buy some new tires if he wants or just wait until the current one wears off. The dealership didn't even bother fixing any of the curb rashes on the wheels if that was the current post on the website.

Wait, isn't 245 outside the range that "fits" a 10" rim? Like Michelin says a 245 is good up to a 9.5" rim. It's one thing to sell as is, but if it's in an unsafe situation (there's a reason why michelin specs rim widths requirements?) wouldn't it go back on the dealer?

No, you'd have to be severely stretched to make it an unsafe situation. Also, every 245 is different. I can find you a 245 from one manufacturer that's wider than a 265 from another. There is no real standardization.

The standardization from what I've researched depends on what the manufacturer states, the manufacturer of that tire will specify a rim-width range where it works.

Different configuration vs. something a manufacturer says is not compatible is a big deal I'd think.

What if it had 12" rotors with the stock calipers? Would that be ok too?

Again, no standardization. Even within the SAME make and model of tire.

As it concerns width, it's the tread width number that you're looking for, and that just changes wildly.

None of this really matters, the bead set just fine I'm sure, and car will just be a bit lively in the rear, but the TC will save him, so it's not a concern.

Y'all seem worried about the 245 on a 10 inch rim at the back.

I'd be more concerned about the overall diameter of the fronts if they really are 245/*45*-19 as the OP has stated. That's a full 20mm additional sidewall/radius. They are almost certainly going to rub on the liners at full lock and possibly under full compression also.

PS. Might even be worth checking he hasn't got 4 x front wheels fitted.

There's one pic in that ad where you can see the size on a tire is 245/40/19 which is still a little larger in diameter but not bad. my snow tires are accidentally "upsized" a touch (245/45/18) and end up the same diameter. Only issue is they rub a little at full lock

Just get the right tires on the car and start there. If it were me, I’d then take it to a reputable shop and give it a once or twice over to make sure everything else is up to speed. These “highway” used car dealers in NJ don’t have the best of reputations.

Not clear what the factory warranty status is on the car, or if a third party warranty was purchased….

But to the extent that the car is under a warranty of any sort, then he'll want to switch the car back to the factory specifications re: tires. Some warranty companies can and will use any reason to deny a claim - consider if your buddy has an issue with his differential, driveshaft, or wheel bearings for example and the warranty company was allowed to use the tires as a way out.
