Sure, just depends on if you care about possible drivetrain claims down the line.

Has BMW started adding the flash counter to the ECUs like Audi/VW have? So there is no way to flash it back to stock without them being able to see a change was made?

I'd drive it stock until warranty is done then mild tune, gives you a little something to look fwd to.

I'm not going to click on that video to give them another view, but who are these hacks?

You can tell looking at the diffuser they don't know what they are doing. That angle is far too steep and the big knee guarantees flow separation.

It's all for looks/show, not for actual performance. Hence why they are cutting the roof off and they beefed up the chassis underneath.

When we hook up ISTA to a car now, which is required for ANY warranty work, it can now tell if the car has been flashed, and will pop up a warning for "engine tuning". So BMW will know instantly.

Yes, it looks for certain things like overrev conditions, flash counter, ect. However savvy tuners know what values they need to not change to avoid triggering this.
