I would contact tuner and ask them to look at engine. Warranty only void if they can prove that tuning caused the issue. If this was a manufacturing defect, tuning becomes less of an issue (most states have comparative negligence standard, which means that if tuning accelerated the engine's demise by 25%, then BMW is liable for only 75% of the claim.
