I'm surprised that with a failed engine, and there are a few recorded on here, that no one has suggested that BMW has interrogated the ECUs for rev range and time data. There's a risk, especially if the car was bought used, that it can prove to have been abused and BMW has a strong case not to allow a goodwill contribution. On the other hand, if the car has been operated within its specification and it fails then it simply is not fit for purpose and the owner has a justifiable claim against the manufacturer. "The ultimate driving machine" should expect to be driven within its performance limit and not fail so catastrophically.
