You mean correct something and admit fault? BMW has never taken responsibility for any bearing clearance issues from what I can tell. Unfortunately the OP will go broke trying to get a judgment against BMW, especially with a tune (regardless of what others are saying). Much cheaper to just have a reputable engine builder check the clearances, blueprint the crank if necessary and replace the bearings.
