I seriously think this is going to be a recall item. I forgot to put in my original post that there was another car, just like mine (but black) that arrived at the dealership 15 minutes before I did with the same problem. They would not tell me the status of that car at the dealership. Be prepared to go back.

I am hoping that is my problem now. They just called me and said they are replacing one of the primary computer boards in my car. Part should show up next week. That will officially mean the car has now spent more time in service, than in my possession.

UPDATE - Still Broken
Now I have an entire new computer system in the car. Unfortunately, the second they took it for a test drive the fuel system still malfunctioned. So, apparently some engineer is flying in to look at the problem who communicates directly with Germany. I'm hoping he can resolve this, although we are looking at 4 weeks without even a diagnosis. I now basically have a new fuel system and a new computer system on my already new car. On the plus side, the dealership and BMW customer relations have been very easy to deal with. As for the payments, I have no payments, although I just realized I'm probably losing a $1000 a month in depreciation and the weather has been great, so no convertible to enjoy.

I've attached a site you can read up more details on, basically if the car is out of service for 30 calendar days in the first 2 years, or in service 4 times for the same issue inthe first 2 years, the car may qualify as a lemon. http://www.carlemon.com/lemon/NY_law.html

Fuel System Malfunction!!
After searching for the longest time to see if anyone else was having Fuel System malfunction issues with their 2012 650-i, I was relief to know I was not the only one...Not a case of "Misery loves company", but rather glad to share my experience.
I have the car for 11 months and have had several electrical problems ranging from low battery triggering the alarm continuously, to loss of power steering, to airbag warning lights, etc. All these problems were apparently resolved except for the Fuel System Malfunction. I have had this problem for the past 5 months, have brought in the car to the Service Dpt., and each time they did something different to fix it, but the problem persisted. They changed the fuel pump; flew in an Engineer from BMW-USA who suggested to change the Computer Board; still, the problem continued. The Dealer suggested I contact BMW North America an file a claim. After three weeks their Customer Relations Dpt. (Someone with the name of Brandon), called back and told me they would not exchange or buy back the car. He did not give me a rational explanation, and was rather arrogant about it. I was outraged; as I told him, I did not buy a Chevy, or a $20k car to be treated like this. So, I hired a Lemmon Law Expert Attorney, and he told me I had a very strogn case. I am suing BMW under the Lemmon Law, and expect to have them buy back the car. It is about time BMW recognizes they have a big problem in their hands, stop giving us the run-around, and start treating us with respect. I agree that this is a Recall waiting to happen. I will post the progress on my case. Hope this helps others with the same problem. |

Got my car back again. Service people's opinions as to whether it was fixed was, "Cautious and Skeptical.". I don't have my paperwork because it was over 1/2 inch thick. They are going to email me a 3 page summary. I know have a new fuel system and computer boards. I'm not sure exactly, but essentially my amperage is testing double where it should be, but just under where the system malfunction light gets triggered. It's kind like the doctor saying my fever is 102 degrees, but until it gets to 103 I can't go to the ER. I wonder what BMW's position is on "You can use the car, but it's not fixed."

How did you manage to convince them to replace your car? Was BMW NA involved? I had to hire a lawyer to get pursue a Lemmon Law suit. AS part of it, I had to bring in the car to the Dlr for one last chance to fix it, but this may be just a formality as they already had 5 chances to fix it and they had no clue what keeps causing the "Fuel System Malfunction" problem. The Service Advisor was surprised BMW NA refused to replace the car.

I took my car to the Dlr for a final attempt. My Attorney, from a firm experienced in these type of cases, believes I have a strong case. Based on his experience, BMW will offer a Settlement, and it's up to me to accept it, or go to Mediation. I am not responsible for Attorney's fees if it gets to that stage.
I also understand that if a manufacturer takes back a car as a"lemmon", they would have difficulty selling it in the U.S. The law requires they disclose in the title that it is a Lemmon. I'll let you know as the case progresses. Also, looking forward to your resolution...Good luck. |

Not sure of the terms of the settlement. I am going for money back + some value on all the time I spent taking the car back and forth for service + legal fees. They may take something for mileage driven. Will let you know once they present me with something.
I was thinking of an M6, but may be an overkill for me. I'd probably consider a 2013 650-i. Hopefully it won't have the same problem. Read the Lemmon Law book provided to you. Each State may be slightly different. At a minimum, it requires that you have brought in the car for repair of the same problem, and the car has spent some number of days in service, even if they gave you a loaner. If you meet the req's, then it may be time to talk to a lawyer. Also, browse the Internet, you'll be surprised the kind of things you find regarding this law. |
