Same reason Mercedes, Audi, and Porsche have never offered remote start.

Regarding your edit, if it was illegal in Germany that still doesn't explain why they haven't allowed a kit for it until now. It could easily have been installed like they do many M Sport parts at the port in North America...or at least at the dealer prior to customer delivery. Also rather sad it doesn't seem to be integrated into the BMW app.
