Hmm, not sure if that's legal!

The speedometer must be working and visible at all times and must never show a speed lower than it actually is, it must also show mph. However I'm not sure if it must show mph all the time or if the capability to show mph is sufficient.

From what you say there are two possible points that may be illegal, although both probably ambiguous :

1) It's not showing mph.
2) The marking around the circumference, in indicating 20-40 at 30mph is potentially showing a speed lower than it actually is.

I'd say worth raising with BMW, it must be possible for a software update to allow a mph display.
