Not sure why it bugged you or not sure why they do that? If the latter, it's so that when you shut the door, the window will be able to inch up in order to form a proper seal.

RHD cars technically aren't illegal in the US, they're just not recommended because our roads aren't designed for them. That said, when you do ED, you always pick up a car spec'd for your home country. I don't think you'd be able to get BMW to build you an RHD car bound for the US, in fact even though RHD cars are legal for consumers to import and drive in the US, I'm not whether manufacturers are allowed to sell RHD cars directly to customers here.
